Agreement, provider and official version
For each agreement, the ‘Provider’ or ‘Licensor’ is the natural or legal person identified as such in the order, accepted quotation or other document incorporating these terms. T-One is the product name and Telemedical Solutions is its trading name; neither replaces the legal identification of the contracting party.
The order must state at least the identity and contact details of the Provider and client, the product or licence purchased, price, taxes, term, authorized scope, included support and the date or version of these terms. If different entities handle sale, licensing, support, updates or diagnostics, the order must identify their roles.
The Spanish version incorporated into the order is the contractual reference version. Translations are provided for convenience and, in the event of conflict, the Spanish version prevails, unless mandatory law or a different written agreement applies.
Mere publication of this page, a demonstration, download, installation or request for information does not by itself create a licence or prove the client's acceptance.
Provider identification
The binding identification of the Provider is the one stated in the order incorporating these terms. The client must retain that document together with the accepted version of these terms.
- Legal notices must be sent to the postal or email address stated in the order.
- General enquiries may be sent to info@telemedicalsolutions.com without including patient data.
- Technical incidents will be handled through support@telemedicalsolutions.com or the support channel stated in the order.
- If the order does not legally identify the Provider, incorporation of these terms into the agreement will not be considered complete.
B2B scope
These terms are intended exclusively for organizations, professionals, distributors and other clients acting within their business or professional activity. They do not govern direct contracting by consumers or patients.
The Provider supplies software, equipment, documentation and, where contracted, installation, training, maintenance or support services. It does not provide healthcare directly to patients through this website.
If the product is offered to consumers or patients, specific terms must be prepared and applicable mandatory rights reviewed before that offer is made.
Contract documents and priority
The agreement may consist of an order, accepted quotation or engagement document; these terms; a licence or maintenance description; product documentation; and, where applicable, a data-processing agreement, service-level agreement or specific terms.
The signed order or agreement will prevail over these terms regarding price, quantity, duration, scope, support and other expressly negotiated conditions. The data-processing agreement will prevail regarding processing on the client's behalf.
No commercial presentation, demonstration or website content will expand the warranties or intended use unless expressly incorporated into the agreement.
Acceptance, authority and authorized users
By signing or accepting an order that incorporates these terms by title, URL and date or version, a person acting for the client represents that they have sufficient authority to bind it. The client must restrict access to authorized personnel and keep internal permissions up to date.
The Provider and client will retain reasonable evidence of the order, accepted version, date, identity of the parties and authority of the person accepting. Publication of a later version does not amend the version already incorporated.
Credentials, activation keys, machine codes and support access must not be shared outside the authorized scope.
T-One licence
Subject to payment and the applicable order, the Provider grants the client a limited, non-exclusive, non-transferable and non-sublicensable licence to install and use T-One for Windows on the authorized computers, sites, users or units.
The duration, perpetual or time-limited model, update and maintenance rights and ability to replace equipment must be stated in the order. A perpetual licence does not imply perpetual support, maintenance or updates.
The licence may be linked to a machine through a hashed technical fingerprint and require activation or verification to protect the product against unauthorized use.
Use restrictions
- Do not copy, distribute, rent, resell, sublicense or make T-One available to third parties without contractual authorization.
- Do not circumvent activation, licence limits, access controls, signatures, encryption or security measures.
- Do not decompile, reverse engineer or attempt to obtain the source code except to the limited extent strictly permitted by mandatory law.
- Do not use T-One to create a competing product, provide a service that was not contracted, introduce malicious code or infringe third-party rights.
- Do not use unapproved versions, devices, integrations or configurations where they could compromise security, interoperability or intended purpose.
Client obligations
The client is responsible for its care environment, legal basis, users, equipment, networks, external accounts, recipients, backups, retention, deletion, continuity and professional compliance.
- Keep Windows, T-One, devices and integrated applications updated and protected.
- Separate accounts and apply least privilege, disk encryption and appropriate physical controls.
- Train users and assistants and follow the documentation for T-One and each manufacturer.
- Verify patients, measurements, files, recipients, links, passwords and results before using or sending them.
- Promptly report incidents, lost credentials, unauthorized use, material errors or security issues.
Clinical limits and emergencies
T-One supports video-consultation workflows and the capture, organization and communication of information. It does not replace clinical judgement, in-person examination, the centre's protocols, manufacturer instructions or official health-record systems.
T-One is not an emergency service, continuous-monitoring system or automatic-response service. In an emergency or where there is immediate risk, the applicable emergency services and protocols must be used.
The healthcare professional remains responsible for interpretation, diagnosis, treatment, referral, follow-up and clinical documentation. The assistant must act within their training and authorization.
Devices, compatibility and intended purpose
Connected devices retain their own intended purpose, labelling, instructions, warnings, maintenance requirements and regulatory status. Technical compatibility does not expand their clinical indication.
The client must check that each device, accessory and configuration is authorized for its territory, environment and intended use.
These terms do not declare T-One to be a medical device or assign it a classification, CE marking, clinical indication or certification. Any valid regulatory statement must appear in the applicable official labelling and documentation for the relevant product or device.
Data protection and roles
For clinical data that the client enters, captures, retains, exports or communicates through T-One, the client will normally be the controller and will decide the purposes, means, legal bases, recipients and periods.
Where the provider processes personal data on the client's documented instructions, the parties must first enter into an agreement compliant with Article 28 GDPR. The public Privacy Policy does not replace that agreement.
Each party will act as an independent controller for data it processes for its own purposes, such as contracting, billing, security, licence management or defence of claims.
The client must complete its risk analysis and, where appropriate, a data protection impact assessment before clinical use.
Local storage, copies and retention
T-One is designed to work mainly on the client's computer. In version 1.7.4, the local database and original files managed by the application are stored encrypted and the keys are kept in the operating system's secure storage; however, previews, pending captures, temporary files, exports, attachments, logs and diagnostic packages may exist without the same encryption.
The client must define which information forms part of the official health record, protect every copy and apply its healthcare and data-protection retention periods. T-One does not itself impose the client's legal retention schedule.
Deleting a patient row, uninstalling T-One or closing an external account does not guarantee deletion of external media, previews, exports, emails, backups, links or recipients' copies. A verified deletion procedure must be used.
Exports, email, cloud and video calls
At the user's selection, T-One may save files, send email through Gmail or Outlook, upload information to Google Drive or OneDrive, create links or open Zoom, Microsoft Teams, Webex or another configured application.
Those providers and recipients will process data according to the account, contract, region, permissions and retention configured by the client. The client must check recipients and legitimacy before each communication.
The provider does not control copies that remain in external services, client accounts, email, networks, backups or recipients' devices.
Shared links, metadata and encryption
The cloud flow may create links visible to anyone who has them. OneDrive may first attempt an anonymous link and, if blocked, use a link limited to the organization.
The user may choose a password-protected ZIP or an unencrypted upload. When there is only a form and no multimedia files, the application may omit the encryption prompt and upload the form as readable text.
The folder name may include the patient's identifying code; that metadata will remain visible to the cloud provider and in the link information even if the ZIP content is encrypted.
The client must treat every link as a communication, apply encryption where appropriate, transmit passwords through a separate channel, restrict permissions and revoke links when they are no longer needed.
Authentication and external services
Google or Microsoft integrations require OAuth authorization and may store access or refresh tokens locally using the operating system's secure storage.
The reviewed permissions include, for Google, user identity and email, Gmail sending and access to files created by T-One in Drive; and, for Microsoft, identity, profile, offline access, email sending and read-and-write file access. The client must use appropriate accounts and review the scope before authorizing.
Signing out locally removes the credentials stored by T-One, but may not automatically revoke consent at the provider. The user must revoke access in Google or Microsoft where appropriate.
Error telemetry and diagnostics
Where an installation is configured with Sentry, errors, performance traces, version, operating system, stack traces and filtered technical context may be sent. Filters reduce risk but do not guarantee detection of every name, path, identifier or free-text entry.
Submitting a diagnostic is a voluntary action that may include the user's message, technical metadata, licence information, paths, logs and a ZIP file. The user must not include patient data, credentials or unnecessary information.
The diagnostic package may also remain on the computer after submission. Remote receipt may use object storage and internal notifications; T-One does not currently provide the user with an automatic deletion control or a fixed retention period. Before submitting personal data, the client must agree in writing the purpose, access, location, subprocessors, transfers, retention and deletion, and may request deletion through the support channel.
Updates and technical changes
T-One may check for updates using licence data, version, platform and the machine's technical fingerprint. Updates may fix defects, compatibility or security and may require a restart or user intervention.
The client must install security updates and maintain a recovery strategy. Indefinite compatibility with operating systems, devices or third-party services that are no longer supported is not guaranteed.
The support period, update rights and end-of-life policy are those stated in the order. The application can technically be configured to query an HTTP or HTTPS endpoint; the client must use only the production configuration supplied by the Provider and a secure connection.
Support, installation and training
Support, installation, training, response times, preventive maintenance and assistance with devices are included only when stated in the contracted order or plan.
The client must provide sufficient technical information and avoid unnecessary clinical data or credentials. If support requires access to personal data, there must be a legal basis, secure channel and applicable data-processing agreement.
The provider may ask the client to reproduce an error, update the product, review the configuration or provide filtered logs before escalating an incident.
Prices, taxes and payment
Prices, currency, taxes, payment schedule, expenses, renewal, refunds and consequences of non-payment will be established in the order.
Unless agreed in writing, a demonstration, quotation or information on the site does not reserve availability or set a final price.
The client may not set off or withhold amounts unless permitted by law or the applicable order.
Confidentiality and security
Each party will protect the other party's confidential information with at least reasonable measures and use it only to perform, administer or protect the contractual relationship.
Information that becomes public without breach, is lawfully known, is lawfully received from a third party or is independently developed will not be considered confidential.
A disclosure required by law will be limited to what is necessary and, where legally possible, the other party will be notified in advance.
Intellectual property
The provider and its licensors retain all rights in T-One, updates, documentation, trademarks, designs, code, general configurations and supplied materials. The licence does not transfer ownership.
The client retains its data and materials. It grants only the limited rights necessary to provide the expressly requested service, support or processing.
Suggestions may be used to improve the product provided they do not disclose client or patient data or confidential information.
Warranties and exclusions
Warranties for equipment, software, installation, conformity, repair and replacement must be defined in the order and coordinated with manufacturer warranties.
T-One does not guarantee that every measurement, file, external service, connection or integration will always be available or error-free. The client must verify results and maintain clinical and operational alternatives.
No warranties are given for third-party services, accounts, links, platforms or devices outside the provider's contractual control.
Limitation of liability
Each party is liable for direct loss caused by its breach, to the extent stated in the order and under applicable law. This page does not itself set an aggregate financial cap or exclude categories of loss; any B2B cap or exclusion must be expressly stated in the order.
No limitation excludes liability that cannot legally be excluded, including fraud or wilful misconduct, personal injury where applicable, mandatory data-protection obligations or other mandatory cases.
To the extent permitted by law, a party is not liable for loss caused by use contrary to documentation, the client's clinical decisions, third-party configurations or services outside its control, missing backups or the other party's breach, unless it also contributed to that loss.
Term, suspension and termination
The term of the licence, maintenance and services will be established in the order. Either party may terminate for a material breach not remedied within the agreed period or for insolvency, without prejudice to other rights.
The provider may suspend access or support where necessary to contain a security risk, unauthorized use or non-payment, applying proportionate measures and giving notice where possible.
On termination, the client will stop unauthorized use and return or delete provider materials where appropriate. Termination does not automatically delete local data, email, cloud copies, backups or records subject to legal retention.
Changes to the terms
The page displays its current date and version. Material changes will not retroactively amend an accepted order unless required by law or expressly accepted by both parties.
A new version may apply to new orders, renewals or extensions where the relevant document incorporates it. Where renewed acceptance is required, the Provider will retain reasonable evidence of it.
Urgent technical changes for security or continuity may be applied in accordance with the order and documentation, without silently expanding processing purposes or clinical uses.
Governing law, disputes and contact
These terms are governed by Spanish law, without prejudice to any applicable mandatory rules. Before commencing proceedings, the parties will try in good faith to resolve the dispute through the contacts stated in the order.
The courts or mechanism expressly agreed in the order will have jurisdiction. If the order does not specify a forum, the courts determined by applicable procedural law will have jurisdiction.
